The full standard terms that apply to every vehicle we supply. Please read at your leisure โ€” most of this is the standard housekeeping you'd expect from any reputable UK dealer.

Welcome, and thank you for taking the time to read through how we work. These Terms of Sale apply to every vehicle supplied by Driveaway Limited (trading as "Drive Away Bargains") and form the agreement between you and us when you reserve, view, or purchase a vehicle from our stock. We've tried to set them out in plain English, in the order you'd actually meet them as a buyer, with the practicalities up front and the standard contractual housekeeping further down the page. Most of this you won't need to think about; it's here so that everyone โ€” buyer and seller โ€” has the same understanding from the moment a deposit changes hands. We update these terms from time to time, and the version that applies to any given purchase is the one in force on the date you place your reservation. 1. About us

Drive Away Bargains is a trading name of Driveaway Limited, a company registered in England & Wales under company number 16242091. Our day-to-day operating contact details are: email sales@driveawaybargains.co.uk, telephone and WhatsApp 07424 377858. We work by appointment, both for forecourt visits and for collection โ€” our team will agree a time and location with you when you reserve. References to "we", "us", "our" or "the Seller" in these terms mean Driveaway Limited; references to "you", "your" or "the Buyer" mean the person or business who reserves or purchases a vehicle from us.

2. How we describe and prepare our vehicles

Every vehicle in our stock has been carefully selected, inspected and prepared before going on sale. Our approach to listings is to be thorough and honest: we publish a 32-point pre-sale checklist that every car has passed, we list every cosmetic and mechanical observation we've identified, we show photographs that include any chips, scratches, or wear we've noted, and where we have access to it we publish service-history information, MOT history, and vehicle provenance. We don't believe in hiding things and we don't believe in "as new" descriptions on cars that aren't new โ€” what we describe is what you'll find on the forecourt.

That said, written and photographic descriptions are necessarily a snapshot in time. Vehicles are physical objects and small variations between description and reality can occur โ€” particularly for a car that may have been driven, moved, or test-driven between the listing being prepared and you arriving for inspection. The descriptions, photographs, mileage figures, MOT data, service-history notes, "what's good / what's not" lists and pre-sale checklist items are provided in good faith as a courtesy to assist you in your buying decision; they are not contractual representations or warranties as to the present or future condition of the vehicle, nor a substitute for your own physical inspection at point of sale. We strongly encourage every buyer to inspect their chosen vehicle in person, or to send a trusted representative or independent inspector to do so on their behalf, before completing the purchase. This is in your interest and ours.

Comparison prices that appear on our listings (for example, "AutoTrader's Price") are sourced from publicly-available third-party listings and aggregators on or around the date the listing was prepared, and are provided purely as a market-context indicator. Third-party prices fluctuate and the figure shown on any given day may not reflect the live market. We do not warrant their accuracy or currency. Our own price is the only price that matters between us and you, and that price is what is shown on the listing on the day you reserve.

3. Our pricing approach

Our entire business model is built on volume, low overheads, and giving the saving back to the buyer. We don't run a polished showroom with high-pressure sales staff on commission, we don't price in extended warranties that most buyers never use and most claims paths frustrate, and we don't add document fees, preparation fees, plate-transfer fees, admin fees, or any of the other extras that traditionally inflate the headline price. The number you see on the listing is the number you pay; nothing more is added at the point of sale beyond any genuine optional extras you may choose to take, which would be agreed and itemised separately.

Because of this, we operate a strict fixed-price policy. The listed price is our best price; we don't haggle. This isn't a negotiating posture โ€” it's how we keep our prices the lowest in the market. If you find a like-for-like vehicle (same year, make, model, derivative, similar mileage and condition) advertised at a lower price by another established UK dealer, please send us the link via WhatsApp and we will, at our sole discretion, consider matching or beating it. We can't extend price-matching to private-seller listings, online auction lots, scrap valuations, vehicles that fall outside our normal geographic reach, vehicles with materially different specification or condition, or listings we reasonably suspect to be fraudulent or otherwise irregular.

All prices on the website are in pounds sterling and are inclusive of UK VAT where applicable. The full balance must be received in cleared funds before a vehicle is released for collection or delivery. Accepted payment methods are debit and credit card, bank transfer (BACS / Faster Payments), and cash subject to the prevailing UK money-laundering thresholds and our anti-money-laundering checks. We may, in our discretion, decline any payment method or any cash transaction in any individual case.

3.1 Scope of our "guaranteed" wording and price-match commitment

For the avoidance of doubt: where we use the words "guaranteed", "guarantee" or any equivalent in our marketing, on the website, on the listing pages, in the hero badge, or in any social or printed material, the word refers exclusively to our pricing position relative to the wider used-car market โ€” namely, that the vehicle is offered at a price at least 20% below a comparable like-for-like market reference at the time the listing is prepared, and that we will consider matching or beating any genuine like-for-like alternative listing presented to us, on the conditions set out in clause 3 above. The word "guaranteed", as used in our marketing, is not a representation, warranty, or guarantee of any kind in respect of the present or future mechanical, electrical, structural, cosmetic, or operational condition of any vehicle, nor as to its fitness for any particular purpose, nor as to its compliance with any standard beyond those expressly required by UK law, nor as to its future reliability, residual value, or freedom from defects. The condition of any vehicle is governed exclusively by clauses 5 and 6 of these Terms, which the buyer is encouraged to read carefully before reserving. Where the price-match request falls within the parameters of clause 3, we will confirm in writing the matched or beaten price; where it does not, we will explain why, and the buyer is free to walk away from the reservation with their deposit refunded under clause 4. Our price-match commitment does not apply to private-seller listings, online auction lots, scrap valuations, vehicles outside our normal geographic reach, vehicles with materially different specification, mileage, or condition, listings we reasonably suspect to be fraudulent or otherwise irregular, or any listing where the comparison-price information cannot be independently verified.

4. Reserving a vehicle

Vehicles can be reserved by paying a deposit, typically ยฃ99, by PayPal, debit/credit card, or bank transfer. Reserving a vehicle takes it off the market for 48 hours from the time the deposit clears, during which window the vehicle will not be offered to other parties. Reservations made by PayPal benefit from PayPal's standard buyer-protection cover where the underlying transaction qualifies for it.

The reservation deposit is treated as a part-payment toward the final purchase price; on completion of the sale, it is deducted from the balance due. Reservations may be cancelled and the deposit refunded in full where the vehicle is no longer available for any reason, where the vehicle on inspection differs materially and adversely from the listing description, or where the buyer cancels in writing (email or WhatsApp confirmation is sufficient) within the 48-hour window and has not already inspected the vehicle. Where a buyer (or the buyer's nominated agent) has physically inspected the vehicle and elects not to proceed for reasons unrelated to material misrepresentation, the deposit may be retained as compensation for the time the vehicle was held off-market and any administrative cost reasonably incurred. We will always try to resolve any concerns informally and amicably first; that is invariably preferable for everyone.

5. Inspections and viewings

All inspections and viewings take place by appointment. When you reserve a vehicle we'll agree a time, and we'll let you know whereabouts to come. Test drives are routinely available on request, subject to a valid driving licence and proof of insurance โ€” a temporary "drive-away" insurance policy obtained on your phone is fine for this purpose; most providers will give you instant cover for a single named day on the chosen vehicle. We don't accompany every test drive but we may, depending on the vehicle, the buyer, and the route. Where you wish to engage an independent third-party inspector (AA, RAC, or similar), we will accommodate this with reasonable notice; the cost of any such inspection is for the buyer's account.

It is the buyer's responsibility to satisfy themselves as to the suitability and condition of the vehicle before completing the purchase. We will assist this in any way we reasonably can, but the decision to proceed is yours. Once cleared funds for the balance have been received and the vehicle has been collected or delivered, the sale is final and the vehicle is yours; ownership and risk transfer at that moment, including the obligation to insure.

6. About vehicle condition and the basis of supply

We're proud of our cars. We genuinely believe that, pound for pound, the vehicles we sell are the best value going on the UK used-car market, which is why we publish our pricing comparisons openly. At the same time, every used vehicle has a story, and any honest dealer will tell you that no used car can be guaranteed in the way a new one might be โ€” there are simply too many variables once a vehicle has been on the road for a few years. With that in mind, the basis on which we supply each vehicle reflects how the trade has worked for generations and how our pricing structure is built.

Each vehicle is supplied on the basis that the buyer has had, or chosen to forego, a full opportunity to inspect the vehicle prior to purchase, and that the buyer accepts the vehicle in the condition presented at point of sale, taking into account its age and mileage. Pre-sale checks, the 32-point checklist, mileage information, MOT records, service history, and "what's good / what's not" lists are provided as a courtesy and as an aid to that inspection; they are not warranties or representations as to present or future condition. To the maximum extent permitted by law in respect of business-to-business sales (and bearing in mind that nothing in these terms operates to limit any right that cannot lawfully be limited), all implied terms relating to satisfactory quality, fitness for any particular purpose, correspondence with description, and merchantability are excluded; the Seller's aggregate liability under or in connection with the supply of any vehicle is limited to the purchase price actually paid by the buyer for that vehicle; and consequential, indirect, economic or business losses are excluded altogether. The buyer's statutory rights as a consumer (where the buyer is acting outside the scope of any business or trade) are not affected, save to the extent that the buyer expressly accepts the trade-sale basis at the point of reservation.

Practically, all of this means that we don't sell warranties; that the vehicle you collect is the vehicle as you saw it at the point of collection; and that, once you've driven away, the vehicle is yours. We're always happy to chat after the sale, recommend a local mechanic we trust, or help you understand any quirk of a particular model โ€” but we don't accept returns and we don't offer rectification or repairs at our cost after the sale has completed. This trade-sale framework is a long-established convention in the motor industry and is the principal reason our prices sit consistently below typical retail.

7. Title, finance and provenance

We carry out a full HPI check on every vehicle prior to listing. We confirm at the point of sale that, to the best of our knowledge and based on the most recent HPI report we have on file: each vehicle has good and marketable title; is not subject to any outstanding hire-purchase or other finance agreement; is not recorded as stolen; is not recorded as a Category A, B, S, or N total loss save where this is expressly disclosed in the listing; is not recorded as a mileage discrepancy save where expressly disclosed; and is not subject to any other adverse marker that we have been able to identify. We will provide the underlying HPI report on request. Where any change to a vehicle's recorded status occurs between listing and sale, we will update the listing or notify the reserving buyer as soon as we become aware of it.

8. Delivery, collection and risk

The default arrangement is collection in person at a time and place agreed when you reserve. Delivery within mainland UK is available on request via covered transporter, typically at a fee of ยฃ100โ€“ยฃ300 depending on distance and access; we'll quote you specifically when you ask. Where delivery is arranged by us, the vehicle is transported on the buyer's behalf by an independent carrier; risk in the vehicle passes to the buyer at the point the vehicle is loaded onto the carrier for delivery, and we recommend the buyer ensure their insurance is in place from that moment. Where collection is in person, risk passes at the point the buyer takes possession. The V5C registration document will be sent to DVLA on the day of sale (or handed to the buyer for the buyer to send, at the buyer's option) and replacement V5Cs typically arrive within three to four weeks; the buyer is responsible for ensuring the new keeper's address is correctly recorded.

9. Cancellation rights

Trade business-to-business sales do not benefit from the consumer right of cancellation under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and our pricing structure presupposes that this is the basis on which we transact. Any consumer-statutory rights that cannot lawfully be excluded are, of course, preserved. In any case where a buyer has a legitimate concern after the point of sale, we'd much rather hear from you than not; we have settled many small issues amicably over the years simply because both sides preferred to talk.

10. Liability

Nothing in these terms operates to limit or exclude the Seller's liability for death or personal injury caused by the Seller's negligence; for fraud or fraudulent misrepresentation; for breach of any term implied by section 12 of the Sale of Goods Act 1979 (right to sell); or for any other liability that cannot lawfully be limited or excluded as a matter of UK law. Subject to that, the Seller's aggregate liability arising under or in connection with the supply of any vehicle, whether in contract, tort (including negligence), under statute, or otherwise, is limited to the purchase price actually paid by the buyer for the vehicle in question, and the Seller is not liable for any consequential, indirect, economic, business, reputational, or third-party loss. The buyer agrees that the limitations and exclusions in these terms are reasonable, having regard to the price at which the vehicle is supplied and the nature of the supply, and that the buyer has had the opportunity to consider those limitations before placing the reservation.

11. Notices and communications

Notices under these terms may be given by email to sales@driveawaybargains.co.uk, by WhatsApp to 07424 377858, or in writing to the registered office of Driveaway Limited as recorded at Companies House from time to time. We accept WhatsApp and email as valid means of contractual notice, including for cancellation of a reservation, given the way our customers actually communicate with us in practice. Notices we give to you will be sent to the contact details you provided when you reserved.

12. Data, privacy and cookies

We process buyer personal data (typically name, contact number, email address, vehicle interests, and payment confirmation details) for the purposes of administering reservations and sales, complying with our HPI, anti-money-laundering and DVLA-notification obligations, providing aftersales communication, and improving our service. We hold data only for as long as is necessary for those purposes or as required by law. We do not sell buyer personal data to third parties; we share data only with payment processors, transporters, and authorities where required for the lawful operation of the business. Our website uses essential and functional cookies necessary for site operation; non-essential marketing or analytics cookies are not set without explicit consent. Buyers may exercise their UK GDPR rights, including subject access, rectification and erasure, by contacting us at the address above; we will respond within the statutory time limits.

13. Force majeure

Neither party is liable for any failure or delay in performance of these terms caused by circumstances beyond that party's reasonable control, including but not limited to acts of God, war, terrorism, civil disturbance, government action, fuel shortage, severe weather, fire, flood, transport breakdown, supply-chain disruption, pandemic, or industrial action. Where such circumstances persist for an extended period, either party may, on reasonable notice, cancel any pending reservation; in that event the deposit will be refunded in full.

14. Variation, severability and entire agreement

No variation to these terms binds the Seller unless it is recorded in writing and signed by an authorised representative of the Seller. If any provision of these terms is held by a court of competent jurisdiction to be unenforceable in whole or in part, the remaining provisions continue in full force and effect, and the unenforceable provision will be deemed modified to the minimum extent necessary to make it enforceable while preserving the parties' original intent so far as practicable. These terms, together with the listing of the relevant vehicle and any written communications expressly forming part of the sale, constitute the entire agreement between the buyer and the Seller in respect of the supply of any vehicle, and supersede any prior representations, statements, brochures or communications, save in respect of fraud or fraudulent misrepresentation.

15. Assignment

The buyer may not assign or transfer the benefit of any sale or these terms to a third party without the Seller's prior written consent. The Seller may assign or transfer its rights and obligations under these terms to any company within the same group or to a successor in title without the buyer's consent.

16. Third-party rights

A person who is not a party to a sale has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these terms; this does not affect any right or remedy of a third party that exists or is available apart from that Act.

17. Governing law and jurisdiction

These terms, any sale concluded under them, and any non-contractual obligations arising out of or in connection with them, are governed by the laws of England & Wales. The parties submit to the exclusive jurisdiction of the courts of England & Wales for the resolution of any dispute arising under or in connection with these terms or any sale.

18. Updates to these terms

We may update these terms from time to time, for example to reflect changes in law, in our payment processors, or in our internal processes. The version that applies to any given reservation or purchase is the version in force on the date the reservation is placed; that version is, in turn, accessible at the bottom of this page from the "last updated" date. Material changes are flagged on the homepage for a reasonable period after they take effect.
